TERMS AND CONDITIONS OF SALE

Validity of the terms and conditions of sale

  1. These terms and conditions of sale apply to the purchase of goods and services between the buyer from the online store www.reztart.ee (hereinafter the Buyer) and the company Indevex OÜ (hereinafter the Online Store www.reztart.ee).
  2. In addition to these terms and conditions, the legal relations arising from the purchase of products from the Online Store reztart.ee are regulated by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legal acts in force in the Republic of Estonia.
  3. The Online Store www.reztart.ee reserves the right to make changes in the terms and conditions of sale. These changes are indicated on the website www.reztart.ee/en/terms-of-sale.

Price information

  1. All the prices in the Online Store www.reztart.ee are given in euros and include 20% VAT.
  2. Payments will be accepted in euros (€).
  3. Prices are valid from the time of placing the order until the expiry of the payment term of the placed order (24 hours after the order is placed).
  4. If the order has been submitted before the change of the sales conditions or the pricelist, the conditions valid at the time of placing the order shall apply to the legal relations between the Buyer and Indevex OÜ.
  5. The Online Store www.reztart.ee reserves the right to make changes in the pricelist. These changes are indicated on the website www.reztart.ee.

Placing an order

  1. Add the desired products to the shopping cart.
  2. To place an order, go to the shopping cart (the link to the shopping cart is located in the header of the page and in the menu) and make sure that the selected goods are correct and in the desired quantities.
  3. To place an order and pay for the goods, click on the link “Proceed to checkout“.
  4. On the ordering page, fill in the required data fields, select the suitable delivery method and the appropriate payment option. You can conveniently pay for the order via a bank link (Swedbank, SEB, Luminor, etc.) or by bank transfer. Details for making a euro payment including all applicable national taxes and additional charges can be found on the invoice displayed after the confirmation of the order.
  5. Please fill in the data and order confirmation page fields carefully, as the fast and smooth delivery of the products you have purchased and the subsequent resolution of disputes and claims depends on the accuracy and correctness of the information provided.
  6. Orders placed in the Online Store are processed on working days (Mon-Fri 10.00–17.00). If the order is submitted on Friday after 14:00, the order will be fulfilled the following Monday.

Entry into force of the sales contract

  1. With the sales contract of the goods, the Online Store reztart.ee undertakes to hand over to the Buyer the existing goods or the goods acquired in the future by the Online Store reztart.ee and make the transfer of ownership to the Buyer possible; the Buyer undertakes to pay the amount indicated on the invoice submitted for the goods by the Online Store reztart.ee and accept the goods.
  2. The orders that have not been paid for will be cancelled in 24 hours after the order is placed.
  3. The sales contract enters into force after the payment made by the Buyer is received in the bank account of the Online Store.

Delivery

  1. Goods sold in the Online Store are delivered in the territory of the European Union.
  2. The delivery costs of the goods are borne by the Buyer and the respective price information is displayed next to the delivery method.
  3. After the sales contract enters into force, the Online Store reztart.ee shall complete the order and hand it over to the company’s logistics partner, Smartpost courier, for delivery.
  4. The parcels normally arrive at the location specified by the Buyer within 5 to 10 working days of entry into force of the sales contract. In exceptional cases, the company serves the right to deliver the goods within 45 calendar days by informing the Buyer in advance.
  5. The delivery terms indicated on the website of the Online Store are valid from the moment the payment for the order is received in the bank account of the Online Store.
  6. Please fill in the data and order confirmation page fields carefully, as the fast and smooth delivery of the products you have purchased and the subsequent resolution of disputes and claims depends on the accuracy and correctness of the information provided.
  7. The Online Store reztart.ee is not responsible for delay in the delivery of the goods if the goods have been handed over to the logistics partner on time, but the delay in delivery is due to circumstances that the Online Store reztart.ee could not affect or foresee.

Right of return

  1. Once the order has been received, the Buyer shall have 14 days to withdraw from the contract entered into with the Online Store. In order to return the goods, a withdrawal application must be submitted, which can be filled in here and sent to info@indevex.com. A standard withdrawal form can be found here.
  2. In the case of any deterioration of the condition of the product subject to return, the Buyer is liable for the diminished value of the product caused by the use of the product only in the case where the Buyer used the product in a manner other than that necessary to establish the nature, characteristics and functioning of the product. In order to establish the nature, characteristics and functioning of the product, the Buyer must only handle and use the product in the same manner as the Buyer would customarily be allowed to do in a store.
  3. Due to the nature of the product, it is not possible to return an item that is not suitable for return for health or hygiene reasons and if it has been opened after delivery.
  4. The Buyer shall return the goods within 14 days after submitting the application or shall submit proof that the goods have been handed to the logistics company within the said time frame. The Buyer shall pay the delivery costs.
  5. Upon receiving the withdrawal application, the Online Store shall immediately, but no later than after 14 days, return to the Buyer all payments received from the Buyer under the contract, including the delivery costs of the used item.
  6. The costs of returning the goods shall be covered by the Buyer unless the reason for return is the fact that the goods to be returned do not correspond to what was ordered (an incorrect or faulty item).
  7. Indevex OÜ has the right not to make a refund until the Buyer has returned the purchased goods or has submitted proof that the goods have been handed to the logistics company.
  8. Indevex OÜ shall make a refund to the same account from which the payment was received.

Force Majeure

  1. The Online Store reztart.ee is not responsible for damages caused to the Buyer or delay in the delivery of goods if the damage or delay in delivery of goods is due to circumstances that the Online Store reztart.ee could not affect or foresee.

Processing of personal data

  1. By entering data in the Online Store and with the corresponding confirmation, the Buyer grants the right to collect and process the Buyer’s personal data (name, contact telephone number, parcel delivery and/or home address, e-mail address) and forward personal data to the logistics partner for delivery.
  2. The Buyer shall have the right to prohibit the collection and use of their personal data at any time, unless it is necessary for recovering a claim arising from the contract or for delivering goods.
  3. When paying for purchases with encrypted data communication with banks, the Buyer ensures the security of personal bank IDs and the Online Store shall have no access to them.

Indevex OÜ shall process your personal data for the conclusion and performance of the sales contract and for other purposes, which are described in our privacy policy. Please read our Privacy Policy, where we have described our rights, obligations and responsibilities as well as your rights in relation to your personal data in detail.

Indevex OÜ is the controller for the purposes of processing of personal data, and Indevex OÜ forwards the personal data needed to execute payments to the processor, Maksekeskus AS.

Procedure for submitting complaints

  1. Please notify us immediately by e-mail info@indevex.com, if the received goods are not the item ordered by you or it is defective, but not later than 2 months from the moment of finding out the non-conformity or defect of the product.
  2. Please include your contact information, date of purchase, a description of the defect in the product, and the content of the complaint.
  3. In case of an incorrectly sent product or poor quality, please fill out the return request. Indevex OÜ shall reimburse the costs related to the purchased product, including delivery costs related to their return. Please keep the documents related to delivery and send them to the e-mail address info@indevex.com together with the order number.

Buyer’s right to apply to the Consumer Disputes Committee

  1. If the Online Store has refused to resolve a complaint, or the Buyer does not agree with the solution offered by the Online Store and believes that their rights or interests have been infringed, the Buyer has the right to file a complaint to the Consumer Disputes Committee via the Consumer Protection Board or to court. The Buyer may file a complaint on their own, or by means of a representative. The data of the Consumer Disputes Commission are presented on the website of the Consumer Protection Board, in order to resolve problems arising in the Member States of the European Union, please contact the European Consumer Centres’ Network.
